By accessing or using Tarsia.ai, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account or using Tarsia.ai, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Responsibilities

When you create an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

3. Acceptable Use

You agree to use Tarsia.ai only for lawful purposes. You may not:

• Create content that is illegal, harmful, threatening, abusive, or hateful
• Generate puzzles containing inappropriate content for educational settings
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use automated tools to access the Service except as permitted
• Interfere with or disrupt the Service or servers
• Resell, redistribute, or commercially exploit the Service without permission
• Use the Service to compete with Tarsia.ai

4. Content and Intellectual Property

Your Content

You retain ownership of the questions, answers, and educational content you create using Tarsia.ai. By using our Service, you grant us a limited license to store, process, and display your content as necessary to provide the Service.

AI-Generated Content

When you use our AI features to generate puzzle content:

• You own the output generated based on your prompts
• AI-generated content may not be unique and similar content may be generated for other users
• You are responsible for reviewing and verifying the accuracy of AI-generated content
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content

Our Intellectual Property

The Tarsia.ai name, logo, and the design, features, and functionality of our Service are owned by us and are protected by intellectual property laws. You may not copy, modify, or create derivative works of our Service without permission.

5. Credits, Payments, Cancellation & Refunds

5.1 Subscription Cancellations

• Cancel Anytime: You may cancel your subscription at any time from your account profile or by emailing support@tarsia.ai.
• Effective Date: Upon cancellation, your subscription remains active until the end of the current billing cycle. No further charges will be applied.
• No Partial Refunds: We do not offer prorated refunds for mid-cycle cancellations.
• Resumption: You may resume a cancelled subscription before the billing period ends to prevent interruption.

5.2 Credit Usage & Expiration

• Final Sale: All purchases of credits (one-time or subscription-based) are final and non-refundable once credits have been used.
• Usage Definition: A credit is considered "used" the moment it is applied toward an AI puzzle generation.
• Expiration: Credits purchased via one-time credit packs never expire while your account remains active. Subscription credits reset each billing cycle.
• Non-Transferable: Credits cannot be transferred between accounts.
• Free Credits: New accounts receive a one-time grant of 3 free AI credits after email verification. This is a promotional offer, not a recurring benefit, and may be modified or discontinued at any time.

5.3 Refund Eligibility

We want you to be happy with Tarsia.ai, but we must prevent system abuse. Refunds are generally granted only under the following conditions:

• Technical Failure: If a system error prevented you from using your purchased credits and our team cannot resolve it.
• 48-Hour Window: For accidental purchases or renewals, you may request a refund within 48 hours of the charge, provided zero (0) credits have been used since the purchase or renewal.
• How to Request: Email support@tarsia.ai with your purchase details. Refunds are processed within 5–10 business days to the original payment method.

5.4 Disputes

Before contacting your bank, please reach out to us at support@tarsia.ai. Most issues can be resolved within 24 hours. Initiating a chargeback without contacting support first may result in the permanent suspension of your account and the forfeiture of all remaining credits.

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

6. Service Availability

We strive to provide reliable service, but we do not guarantee that Tarsia.ai will be available at all times. We may:

• Perform maintenance that temporarily affects availability
• Modify, suspend, or discontinue features with reasonable notice
• Experience downtime due to factors beyond our control

We will make reasonable efforts to notify users of planned maintenance or significant changes to the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TARSIA.AI AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold harmless Tarsia.ai, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

10. Termination

You may terminate your account at any time by contacting us. We may terminate or suspend your account:

• For violation of these Terms
• For fraudulent or illegal activity
• If required by law
• At our discretion with reasonable notice

Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in the United States.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Miscellaneous

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tarsia.ai.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
• Waiver: Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.
